Labour Market Impact Assessment (LMIA)

LMIA or Labour Market Impact Assessment is a document that is issued by Employment and Social Development Canada (ESDC) which assesses the effect of hiring a foreign national in Canada.

    A positive LMIA signifies that there is no Canadian citizen to fill that position, so favors the hiring of a foreign national. A negative LMIA shows that the position should be filled by a permanent citizen or a Canadian citizen.

    To obtain an LMIA, applications are submitted by mail or in hard copy to the Service Canada Processing Centre. Furthermore, applicants need to ensure that the following criteria are met.

    Processing fee

    • The applicants are required to pay a $1000 processing fee, which is completely non-refundable, regardless of the results. Some applicants, that fall under LMIAs for in-home caregivers, are exempted from this fee.
    • The employers have to submit a plan that outlines their intent to address the need to hire foreigners.

    • Documents need to be submitted that prove the legitimacy of the employer as a Canadian citizen.
    • The employers also need to submit substantial evidence that they have made enough efforts, before hiring TFW, to recruit permanent residents and Canadian citizens.

    Wages

    • Applicants also need to include enough information about TWF's wages. This is to ensure that the TFWs are paid the same wage as their Canadian equals.
    • The TFWs are also entitled to the same workplace health and safety standards as the Canadians. Substantial evidence that the TFWs will be covered by insurance also has to be provided by the employers.
